Complete Marketing Solution 

Our goal with this proposal is to provide you with a full-scale marketing strategy and implementation plan as an alternative route to hiring a single in-house employee. With this proposal, you'll receive access to a team of professional marketers ready for immediate action and a game plan for your organization.

Deliverables for this proposal will include 3 primary goals, ranging from immediate to long-term in nature:

  1. Implementation
    • Our marketing strategies and training will better enable your team for the long-term initiatives, but your organization is facing limited bandwidth issues internally due to staffing.
    • We aim to bridge the gap by immediately implementing better solutions for your organization, while also filming and providing documented insight as to what we did, why we did it, and how it works.
  2. Organizational Structure
    • While many of the efforts that will be immediately noticeable will be "customer facing", there are other resources that need to be built out to assist in the organizational structure of ESP.
    • For example, we will build out a wiki-portal complete with user-permissions on a per user basis where documented processes, digital resources, and documentation can be housed.
  3. Training Strategies for Repeatable Processes
    • The goal of your organization is to grow to new locations. The goal for this proposal is to provide you with systems that can be immediately employed whether you are in Athens, Georgia or San Francisco, California.
    • We teach processes and systems that will work for any organization in any location so that you can maximize the Return on Investment from this partnership.
    • This is an example workflow of a deliverable game plan that would work for event promotion for ESP in Watkinsville that could also work for Java Joy in Nashville, TN

Web Design, Development, and Deployment

This project will be developed on a LAMP software stack (Linux, Apache, MySQL, PHP). We will build your site on the latest version of Word Press with multiple extensions, components, plugins, and customized development to help us achieve our goals.

We will rely on you to provide content for the pages of the site, as well as images you'd like to use. Much of the content will come from the existing site.

Google My Business Optimization

Having a strong presence in the Local search results means having a properly optimized GMB listing both on-page, and off-page. We will be running an aggressive campaign for up to five keywords within your immediate area and then working our way out. This campaign will take up to 5 months to come to completion.

Local Search Engine Optimization

52% of all search result clicks go through the 3 pack (aka "Maps Pack"). Ranking within that 3 Pack is done via a process known as Local Search Engine Optimization. Though citations and GMB optimization is at the core of Local SEO, this campaign will be more than just the culmination of these two foundational pieces. For this Local SEO campaign, we will also create internal content silos targeting specific locations within our target radius as well as external backlinks to increase our Domain Authority.

A workflow for this linking strategy can be found HERE, taken from our complete Link Building Strategy. This will be a concentrated effort to accomplish the following short-term and long-term goals:

  • Establish geographic relevance
    • via Internal content silo strategies
  • Establish domain and page authority
    • via External Backlinking Strategies
  • Establish contextual relevance
    • via inner-linking and back-linking strategies

Organic Search Engine Optimization

Ranking within the Organic search results is a completely separate process from Local SEO. This process includes target-rich content that is run through a scoring algorithm (the calculator we looked at together) to see the numerical scores that we need to achieve in order to rank well. This is accomplished by a combination of the following tasks:

  • Hyper-Local SEO plan based on combination of keywords + town/suburb/neighborhood names
  • Content Silos for the target areas including primary cities, sub-locations, "things to do", and points of interest
    • This builds geo-relevancy as well as authority for Google
  • Requires you to submit a 2,000 word article which will be processed by our internal team

Paid Ad Placement Strategies and Implementation

Strategically target (and re-target) audiences via paid ad campaigns. This will include the grant funds provided by Google as well as us applying for grant funds from other providers (ex: Facebook). This will target 4 core audience categories:

  • Potential Members (specifically the family members of potential members)
  • Donors / Contributors
  • Volunteers

Note that this will also include implementation for things like Big Hearts and other fundraising campaigns and events.

Automated Chat Bots

Automated chat-bots are arguably the most intuitive and advanced ways to turn visitors into leads for your business. We will develop a custom chatbot for you within this package, containing up to 15 modules. Though you can utilize this bot however you'd like, we recommend that you develop one customer-facing bot that would collect lead information on the front-end of your site.

HerSource Health Mobile App - SOW

Introduction / Background / Philosophy

System X Designs has carefully selected subject matter experts for each position of our team. We harness a unique set of skills ranging from process automation and optimization (through utilization of custom software) to  web and mobile app development. We have worked on projects for very large, household company names as well as local businesses with more modest budgets. We have found that our services are best utilized when partnered with businesses doing between $25M and $250M in annual revenue. While our goal is to partner with companies on multiple levels in the implementation of their marketing strategy, it is not uncommon for us to also handle stand-alone projects for the Marketing or Operations departments within those organizations.

Our development process operates off the notion that our solutions should produce predictable, repeatable, and scalable results in order to be considered successful.

Objectives

The purpose of this project is to develop and deploy HerSource Health App, a mobile application that will effectively connect lactation consultants with mother/child patients through video consultations. This custom telehealth solution will integrate with the insurance providers of the patients and pair them with providers who accept that insurance payment.

Scope of Work

Development Platform

HerSource Health App  will be built on the following software stack:

  • Joomla CMS 3.9.21
    • The Content Management System will handle our content, users, user access levels and api integration logic.
  • PHP (7.2 or higher)
    • This will be used for the libraries, api integration and mobile services.
  • Mysql (5.7.x or higher)
    • Database management tool. 
  • Twilio.com (Video Call API)
    • This paid service will be used for the seamless video experience for the users.

Prerequisites from Twilio Support list for iOS and Android APP SDK:

ANDROID :

  • Android Studio 2.0 or higher
  • Support for Android API level 16 or higher
  • Support for Java 8

iOS:

  • Xcode 11.0+
  • Swift projects must use Swift 4.0 or higher
  • Support for iOS 11.0+

Our deliverability of the application will meet or exceed professional standards for both HIPAA and PCI compliance. Note that PCI compliance will be dictated by the current PCI compliance standards of your existing Magento installation, since it will be facilitating the transfer of all e-commerce transactions.

General Workflow

  • A patient will request a consultation with a lactation specialist for a specific time and date
    • Based on the profile of the patient, we will know their insurance provider
  • The system will exclude consultants based off multiple criteria
    • First, it will exclude any consultants that do not accept the insurance provider of the patient
    • Next, it will exclude any consultants that are not available at the requested time slot
    • If no consultants are available at the requested time slot, it will recommend other times when qualifying consultants are available
  • One the appointment is set, the consultant will interface via video chat with the patients
    •  We will incorporate an interface for the provider to view the patient while simultaneously charting the record of the visit within the platform
      • This functionality will likely require a web-based application be built which interfaces with the mobile app
      • Will include video for face-to-face interaction
      • Will also include "chat" functionality which will allow for the sharing of links, basic notes (correct spelling of products, etc.), documents, etc.

Additional Functionality

We will design a visual representation of the multiple products and services for which a patient (mother) is eligible based on her health insurance. In order to retrieve this information, we will utilize existing API integrations and return back these eligible products/services which will be represented by icons in their profile.  While this can be implemented in a number of ways, our aim is to represent this information in an aesthetically pleasing manner through representative icons and graphics which will depict each product/service as eligible, not-eligible, or already claimed.

Likewise we will incorporate a way to "recommend" products that the mother is eligible for, including products such as breast pumps, maternity compression, breast pump resupplies, and more.

  • The electronic health records will be templated in the way that the providers can easily input the information from the consultation into a record keeping system
    • During the first phase of implementation, the modification of templates will likely be fairly limited in nature unless we can see various forms and their modifications in advance
  • We will also explore the integration with Epic Medical Records via API access that they provide
  • We would like to explore the integration of your Magento website into the app for a singular point of purchase and record keeping for additional products and supplies
    • Our team is very familiar with Magento, having built e-commerce shots which integrated hundreds of thousands of products from multiple distributors as well as the inventory levels of each SKU
  • Outbound Communications will be available in three forms from the mobile app:
    • Secure Email
    • SMS (via Twilio)
    • Push Notification (link to a screen within the mobile app, behind login)
    • Note: the RFP originally requested Fax, but I'm not sure this would meet HIPAA / PCI compliance guidelines

Development Timeline & Phases

The development will include multiple phases, some of which will be in operation simultaneously or will overlap during portions of the execution of those phases. Note that from the time that we begin the Discovery Phase, we will have an estimated time frame for Beta Launch  of approximately three months, with an estimated deployment of the app at the end of the fourth month.

  • Discovery Phase
    • Begins: Immediately
    • Objectives:
      • Understand the existing API integrations that are currently available
        • We will need to completely understand the integrations for the Health Insurance providers 
        • Identify and update deprecated APIs that will not be allowed for use in the Google Play or iOS App store
        • Magento API connections that can be utilized for the pulling of products and pushing of purchase information
        • Epic Medical Records for storing information as desired by AeroFlow team
      • Understand forms that will need to be developed within the app
        • Registration / onboarding forms
        • Existing forms that are currently in use by AeroFlow that will be applicable to this app
      • Marketing Guidelines
        • Understanding the branding requirements as set forth by the marketing team
          • Hex Color Codes for primary and secondary color schemes
          • Logo usage requirements (if applicable)
          • Any additional Marketing Requirements that pertain to the brand, mobile app, website, products, etc.
      • Technical Documentation
        • Thoroughly review any and all documentation that can provided by AeroFlow pertaining to the site, the existing API integrations, the database schemas that are currently in use and will be accessed by the mobile app, etc.
    • Estimated Time: 2 Weeks
  • Design Phase
    • Begins: After consultation with the marketing team to establish the Marketing Guidelines set forth in the Discovery Phase
    • Objectives:
      • Wireframes
        • Utilizing the marketing compliance guidelines established in the discovery phase, we will implement the wireframes for each applicable page to the satisfaction of the AeroFlow team
      • Icon creation / implementation
        • Icons are a great way to depict a lot of information on mobile devices without cluttering the smaller screen
        • We will design these icons to the satisfaction of the AeroFlow team and utilize them in the various applicable wireframes established above
    •  Estimated Time: 3 Weeks
  • Development Phase
    • Begins: Simultaneous to Design Phase, after completion of the Discovery Phase
    • Objectives:
      • Prioritize the development protocols to eliminate or reduce re-work
        • This will include task creation and assignment to the appropriate System X Designs team members
      • Based on the  findings of the Discovery Phase, we begin connecting the API integrations with the appropriate end points within the app
        • Will require a sandbox installation for testing, which we can create if there is not an existing development environment available to us
      • Twilio Integration
        • Integration and Implementation with Twilio's HIPAA compliant services for both SMS and Video chat
    • Estimated Time: 3 Months
  • Testing Phase
    • Deployment via TestFlight for testing purposes
    • App Stability
      • Identify any app crashes, the causes, and the suitable actions to prevent future instablity
    • General Functionality
      • Identify missing features of general functionality including (but not limited to):
        • Onboarding of clients
        • Video Chat and additional communications
        • Purchasing of products
        • Note taking and record keeping from consultants
    • Security
      • We will utilize the services of a third-party penetration analyst for review of our implementation both within the coding of the file structure, the databases, the API integrations, and the hosting environments
    • Estimated Time: 2 Weeks

    •  Fine-tuning and adjusting of developmental requirements discovered in the Testing Phase
    • Intense testing and analysis of updates made from bullet point above
      •  Still being done in TestFlight
    • Uploading into the AeroFlow Developer Accounts for both iOS and Google Play app stores
    • Estimated Time Frame: 2-3 Weeks

Financial Outline

The financial obligation for this project will range between $88,000 and $100,000 depending on the timeframe of implementation, the number of re-work requirements, and how much of the existing API integration protocols can be used.  For financial planning, I would recommend allocating the $100,000 and if we come in under that- then it helps the budget.

For a payment schedule, System X Designs is unique in that we can offer flexible financial  options that many other agencies cannot facilitate. If there are financial incentives to place expenses in specific fiscal quarters or years, then please let us know and we will work out a plan that will help produce a creative solution suitable for both parties.

Payment Schedule

If there is no need for creative accounting solutions to assist in the fiscal needs of AeroFlow, then we would recommend an even distributions of $20,000 per month for five months- with any savings incurred in the final payment.

Additional Financial  Obligations

Note that any external software  costs that will be incurred will  be done so at the expense of AeroFlow, to include but is not limited to Twilio or UpDox usage. Your data usage will determine your billable amount each month, and can be more closely examined at their pricing page (SMSVideo Chat).

Terms and Conditions

System X Designs Agreement

This Search Engine Optimization and Reporting Agreement (“Agreement”) is hereby entered into between you, your employees and agents (collectively “Customer”) and applies to the purchase of all Search Engine Optimization and Reporting Services (hereinafter collectively referred to as “SEO Services”) ordered by Customer.

  1. Term and Termination – This Agreement shall be effective as of the time frame Customer signs up for SEO Services. This Agreement may be terminated by either party upon written notice to the other, if the other party breaches any material obligation provided hereunder and the breaching party fails to cure such breach within thirty (30) days of receipt of the notice. This Agreement may be terminated by System X Designs (i) immediately if Customer fails to pay any fees hereunder; or (ii) if Customer fails to cooperate with System X Designs or hinders System X Designs’ ability to perform the SEO Services hereunder.

  2. SEO Services – System X Designs agrees to provide Customer with SEO Services as described in this Agreement. System X Designs is authorized to use the specific keywords and/or phases provided by Customer for development, improving the ranking of, and/or positioning the contents of the Customer’s URL(s) in search engines and/or directories. SEO Services are intended to provide the Customer with preferential positioning in selected search engines and report results on an ongoing and timely basis. SEO Services include:

    • Research keywords and phrases to select appropriate, relevant search terms.
    • Submit Customer’s pages to search engines and directories as set forth in this Agreement.
    • Modify the title tags, meta tags, content, HTML code, URLs and other on-page factors.
    • Create positioning reports showing rankings in the major search engines and under which keywords.
  3. Fees; Limitations on Refunds and Cancellation Fees – Customer agrees to pay System X Designs any and all fee(s) as billed in accordance with this Agreement. The fee(s) must be received prior to the start of any SEO Services. THE CUSTOMER FURTHER AGREES THAT, IN THE EVENT OF ANY TERMINATION OF THIS AGREEMENT BY CUSTOMER, NO REFUNDS SHALL BE GIVEN UNDER ANY CIRCUMSTANCES WHATSOEVER. THE CUSTOMER FURTHER AGREES TO PAY UPON CANCELLATION THE AMOUNT OF ANY CANCELLATION FEES OR OTHER AMOUNTS DUE TO System X Designs AS PROVIDED IN THE AGREEMENT. System X Designs IS HEREBY AUTHORIZED TO CHARGE CUSTOMER’S CREDIT CARD ACCOUNT OR OTHER PAYMENT MECHANISM FOR ANY AMOUNTS OWED FROM TIME TO TIME BY CUSTOMER TO System X Designs.

  4. Customer Responsibilities – For the purposes of providing these services, Customer agrees:

    • To provide System X Designs with FTP access to its web sites for uploading new pages, and making changes for the purpose of SEO Services optimization or approval to go through a third party.
    • To authorize System X Designs use of all Customer’s logos, trademarks, Web site images, etc., for use in creating informational pages and any other uses as deemed necessary by System X Designs for search engine positioning and optimization.
    • That if Customer’s web site(s) is light in textual content, Customer will provide additional relevant text content in electronic format for the purpose of creating additional web pages. Customer agrees to provide content, for example 200 to 500 word “articles” about each of their keyword phrases.
  5. Search Engines – Selected search engine submissions include:

    • Google
    • Yahoo
    • Bing
    • AOL
    • Ask
  6. Customer Acknowledgements – Customer understands, acknowledges and agrees that:

    • System X Designs has no control over the policies of search engines or directories with respect to the type of sites and/or content that they accept now or in the future. Customer’s web site(s) may be excluded from any search engine or directory at any time at the sole discretion of the search engine or directory entity. System X Designs will resubmit those pages that have been dropped from the index.
    • Some search engines and directories may take as long as two (2) to four (4) months, and in some cases longer, after submission to list Customer’s web site(s). Occasionally, search engines and directories will stop accepting submissions for an indefinite period of time. Occasionally, search engines and directories will drop listings for no apparent or predictable reason. Often, listings will “reappear” without any additional submissions. Should the listing not reappear, System X Designs will re-submit the web site(s) based on the current policies of the search engine or directory in question.
    • Some search engines and directories offer expedited listing services for a fee. System X Designs encourages Customer to take advantage of these expedited services. Customer is responsible for all expedited service fees.
  7. Web Site Changes – System X Designs is not responsible for changes made to Customer’s web site(s) by other parties that adversely affect the search engine or directory rankings of Customer’s web site(s).

  8. Additional Services – Additional services not listed herein will be provided for a fee of $100.00 per hour. System X Designs is not responsible for developing new content or writing new copy for Customer. Customer will be charged an additional fee for writing content, based on the hourly rate of $100.00 per hour.

  9. Indemnification – Customer shall indemnify and hold harmless System X Designs (and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees) from any and all claims, damages, liabilities, costs, and expenses (including, but not limited to, reasonable attorneys’ fees and all related costs and expenses) incurred by System X Designs as a result of any claim, judgment, or adjudication against System X Designs related to or arising from (a) any photographs, illustrations, graphics, audio clips, video clips, text, data or any other information, content, display, or material (whether written, graphic, sound, or otherwise) provided by Customer to System X Designs (the “Customer Content”), or (b) a claim that System X Designs’s use of the Customer Content infringes the intellectual property rights of a third party. To qualify for such defense and payment, System X Designs must: (i) give Customer prompt written notice of a claim; and (ii) allow Customer to control, and fully cooperate with Customer in, the defense and all related negotiations.

  10. Disclaimer of All Other Warranties – System X Designs DOES NOT WARRANT THAT THE SEO SERVICES WILL MEET THE CUSTOMER’S EXPECTATIONS OR REQUIREMENTS. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE IS WITH CUSTOMER. EXCEPT AS OTHERWISE SPECIFIED IN THIS AGREEMENT, System X Designs PROVIDES ITS SERVICES “AS IS” AND WITHOUT WARRANTY OF ANY KIND. THE PARTIES AGREE THAT (A) THE LIMITED WARRANTIES SET FORTH IN THIS SECTION ARE THE SOLE AND EXCLUSIVE WARRANTIES PROVIDED BY EACH PARTY, AND (B) EACH PARTY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, RELATING TO THIS AGREEMENT, PERFORMANCE OR INABILITY TO PERFORM UNDER THIS AGREEMENT, THE CONTENT, AND EACH PARTY’S COMPUTING AND DISTRIBUTION SYSTEM. IF ANY PROVISION OF THIS AGREEMENT SHALL BE UNLAWFUL, VOID, OR FOR ANY REASON UNENFORCEABLE, THEN THAT PROVISION SHALL BE DEEMED SEVERABLE FROM THIS AGREEMENT AND SHALL NOT AFFECT THE VALIDITY AND ENFORCEABILITY OF ANY REMAINING PROVISIONS.

  11. Limited Liability – IN NO EVENT SHALL System X Designs BE LIABLE TO CUSTOMER FOR ANY INDIRECT, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE, LOST PROFITS, WHETHER OR NOT FORESEEABLE OR ALLEGED TO BE BASED ON BREACH OF WARRANTY, CONTRACT, NEGLIGENCE OR STRICT LIABILITY, ARISING UNDER THIS AGREEMENT, LOSS OF DATA, OR ANY PERFORMANCE UNDER THIS AGREEMENT, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY PROVIDED HEREIN. THERE SHALL BE NO REFUNDS. System X Designs MAKES NO WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, WITH REGARD TO ANY THIRD PARTY PRODUCTS, THIRD PARTY CONTENT OR ANY SOFTWARE, EQUIPMENT, OR HARDWARE OBTAINED FROM THIRD PARTIES.

  12. Customer Representations – Customer makes the following representations and warranties for the benefit of System X Designs:

    • Customer represents to System X Designs and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to System X Designs are owned by Customer, or that Customer has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend System X Designs and its subcontractors from any claim or suit arising from the use of such elements furnished by Customer.
    • Customer guarantees any elements of text, graphics, photos, designs, trademarks, or other artwork provided to System X Designs for inclusion on the website above are owned by Customer, or that Customer has received permission from the rightful owner(s) to use each of the elements, and will hold harmless, protect, and permission from the rightful owner(s) to use each of the elements, and will hold harmless, protect, and defend System X Designs and its subcontractors from any liability or suit arising from the use of such elements.
    • From time to time governments enact laws and levy taxes and tariffs affecting Internet electronic commerce. Customer agrees that the client is solely responsible for complying with such laws, taxes, and tariffs, and will hold harmless, protect, and defend System X Designs and its subcontractors from any claim, suit, penalty, tax, or tariff arising from Customer’s exercise of Internet electronic commerce.
  13. Confidentiality – The parties agree to hold each other’s Proprietary or Confidential Information in strict confidence. “Proprietary or Confidential Information” shall include, but is not limited to, written or oral contracts, trade secrets, know-how, business methods, business policies, memoranda, reports, records, computer retained information, notes, or financial information. Proprietary or Confidential Information shall not include any information which: (i) is or becomes generally known to the public by any means other than a breach of the obligations of the receiving party; (ii) was previously known to the receiving party or rightly received by the receiving party from a third party; (iii) is independently developed by the receiving party; or (iv) is subject to disclosure under court order or other lawful process. The parties agree not to make each other’s Proprietary or Confidential Information available in any form to any third party or to use each other’s Proprietary or Confidential Information for any purpose other than as specified in this Agreement. Each party’s proprietary or confidential information shall remain the sole and exclusive property of that party. The parties agree that in the event of use or disclosure by the other party other than as specifically provided for in this Agreement, the non-disclosing party may be entitled to equitable relief. Notwithstanding termination or expiration of this Agreement, System X Designs and Customer acknowledge and agree that their obligations of confidentiality with respect to Proprietary or Confidential Information shall continue in effect for a total period of three (3) years from the effective date.

  14. Force Majeure – Neither party will be liable for, or will be considered to be in breach of or default under this Agreement on account of, any delay or failure to perform as required by this Agreement as a result of any causes or conditions that are beyond such Party’s reasonable control and that such Party is unable to overcome through the exercise of commercially reasonable diligence. If any force majeure event occurs, the affected Party will give prompt written notice to the other Party and will use commercially reasonable efforts to minimize the impact of the event.

  15. Relationship of Parties – System X Designs, in rendering performance under this Agreement, shall be deemed an independent contractor and nothing contained herein shall constitute this arrangement to be employment, a joint venture, or a partnership. Customer does not undertake by this Agreement, or otherwise, to perform any obligation of System X Designs, whether by regulation or contract. In no way is System X Designs to be construed as the agent or to be acting as the agent of Customer in any respect, any other provisions of this Agreement notwithstanding.

  16. Notice and Payment – Any notice required to be given under this Agreement shall be in writing and delivered personally to the other designated party, mailed by certified, registered or Express mail, return receipt requested or by Federal Express. Either party may change its address to which notice or payment is to be sent by written notice to the other under any provision of this paragraph.

  17. Jurisdiction/Disputes – This Agreement shall be governed in accordance with the laws of the State of Georgia. All disputes under this Agreement shall be resolved by litigation in the courts of the State of Georgia including the federal courts therein and the Parties all consent to the jurisdiction of such courts, agree to accept service of process by mail, and hereby waive any jurisdictional or venue defenses otherwise available to it.

  18. Agreement Binding on Successors – The provisions of the Agreement shall be binding upon and shall inure to the benefit of the Parties hereto, their heirs, administrators, successors and assigns.

  19. Assignability – Customer may not assign this Agreement or the rights and obligations thereunder to any third party without the prior express written approval of System X Designs. System X Designs reserves the right to assign subcontractors as needed to this project to ensure on-time completion.

  20. Waiver – No waiver by either party of any default shall be deemed as a waiver of prior or subsequent default of the same of other provisions of this Agreement.

  21. Severability – If any term, clause or provision hereof is held invalid or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or operation of any other term, clause or provision and such invalid term, clause or provision shall be deemed to be severed from the Agreement.

  22. No Inference Against Author – No provision of this Agreement shall be interpreted against any Party because such Party or its legal representative drafted such provision.

  23. Disputes – Customer and System X Designs agree to make a good-faith effort to resolve any disagreement arising out of, or in connection with, this Agreement through negotiation. Should the parties fail to resolve any such disagreement within ten (10) days, any controversy or claim arising out of or relating to this Agreement, including, without limitation, the interpretation or breach thereof, shall be submitted by either party to arbitration in Oconee County, Georgia and in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted by one arbitrator, who shall be (a) selected in the sole discretion of the American Arbitration Association administrator and (b) a licensed attorney with at least ten (10) years experience in the practice of law and at least five (5) years experience in the negotiation of technology contracts or litigation of technology disputes. The arbitrator shall have the power to enter any award that could be entered by a judge of the state courts of Georgia sitting without a jury, and only such power, except that the arbitrator shall not have the power to award punitive damages, treble damages, or any other damages which are not compensatory, even if permitted under the laws of the State of Georgia or any other applicable law. The arbitrator must issue his or her resolution of any dispute within thirty (30) days of the date the dispute is submitted for arbitration. The written decision of the arbitrator shall be final and binding and enforceable in any court having jurisdiction over the parties and the subject matter of the arbitration. Notwithstanding the foregoing, this Section shall not preclude either party from seeking temporary, provisional, or injunctive relief from any court.

  24. Read and Understood – Each Party acknowledges that it has read and understands this Agreement and agrees to be bound by its terms and conditions.

Understanding the Prospecting Process

When prospecting, there are a series of steps which we will follow as a general guide. Sometimes not all steps are needed, and other times there are additional steps required that aren't listed below. As a general guideline, the process works as follows:

  • Using Google, Yelp, or other means of research, identify prospects that you would like to target.
  • Identify the owner or decision maker, and attempt to obtain their email address.
    • LinkedIn
    • Contact Us pages
    • Google their name and business
    • Guess their email with online mail checking tools
  • Once you have identified the decision maker and have their email address, submit the SEO Email Prospecting form.
    • Screenshots and decent competitor information will enhance the Click-Through rate.
    • This will tell the prospect that you have put together some information for him about some issues with his site, and you are wondering if he is the right person to send that information. If not, who should you send it to...
  • If the prospect replies favorably and says that they do want to see the information, then you'll take the following steps:
    • Generate the Report
    • Create a quick YouTube video (with Private Settings) which walks them through whatever the highest level issues are from the report
    • Fill out the Send Prospect Video form, which will automatically create the page with the video, etc. and email it to the prospect

RSTickets - WYSIWYG Permissions

In my configuration, users that are in the registered group can use the WYSIWYG editor just like administrators. However, if they are not in the administrator group, the front end of the ticket does NOT show any of the HTML markup (although the ticket originally generated does show the markup). If I add that user to an admin group and refresh the ticket, it shows the correct format. If I remove them so that they are only in the Registered group, the ticket reply goes back to just regular text instead of the markup. I'm assuming this is a configuration setting that I have set incorrectly, but I don't know where it is. Please see the video below displaying what I'm referring to.

CMS Logos For Website DevelopmentContent Management Systems are the fastest, easiest, most efficient way to build a website. They allow you to not start from scratch on the development of every little piece, and are often times designed with core functionality that can be utilized to scale development efforts and capabilities. The most well-known and popular CMS on the market today is Wordpress. Wordpress was originally developed as a blogging software and has become increasingly popular in recent years- for many good reasons! It's easy to use, easy to maintain, flexible, and incredibly easy for users with little-to-no programming skills to add/edit content. For smaller businesses that only have a few pages of content for their readers, Wordpress is certainly worth considering.

Aside from Wordpress, there are dozens of other CMS options that are worth considering depending on your project requirements. Many of our larger, more complex projects have been developed in Joomla because of its native capability to robustly handle User Based Permissions. This is important when you want to share information with some groups of users, but not others (ex: departments within a company). Other projects have utilized Magento because of its fantastic E-Commerce capabilities. Drupal also has some fantastic options for more experienced users.

There are many options that all have advantages and disadvantages. However, when choosing both a Content Management System as well as a Web Design and Development firm, there are a few things of which you should be cautious:

Avoid web-designers who only use Wordpress!

While Wordpress is certainly a fantastic option for many sites, be weary of any companies who exclusively use Wordpress. Due to the simplistic nature of Wordpress, it allows many people to play in the development game who might not have the required skills to handle more complex tasks. While your project might be a 5 page website and a contact form right now (easy for Wordpress to handle), you might decide in a year that your site needs some increasingly complex functions to really make it an integral part of your business. As the complexity of your site grows, you might quickly outgrow the web-designer that originally built your site. This is a large difference in web-designers and true web-developers.

Another potential issue that you might face with web-design companies that don't truly understand search functions and algorithms is that your new, beautiful site will likely lack a lot of the necessary tweaks to make it completely optimized for the major search engines (specifically, Google). If your new site isn't completely optimized, then you will likely never rank as well as you should in your industry. This means missed opportunities and fewer customers who found you online.

So while Wordpress certainly has a solid place in the market, be careful about dealing with any web-design group that only has experience in Wordpress... There are a number of reasons that could be potential issues down the road.

Make sure that you choose a CMS that Can Handle Growth and Increasing Complexity

Out of all the magnificent options that you have for a PHP based Content Mangement System, there are really four primary contenders in the market:

  • Wordpress
  • Joomla
  • Drupal
  • Magento

Magento is exclusively an E-Commerce platform (and an awesome one, to be sure), so we will exclude it from this conversation. In order of user complexity they are as listed above, with Wordpress being the most simple to use and Drupal being the most difficult. With that said, it's important to note that with complexity generally comes power. This is why many of our projects are built in Joomla. The backend is certainly easy enough for a "non-coder" to use with no trouble, yet the overall native capabilities are a good bit more robust than those of Wordpress. Since many of our projects have been "larger" and more complex in nature- it makes sense that we have chosen different tools for each job. 

Define your project as clearly and neatly as you can, and let's talk about some of the long-term goals for your company and your website. We'll help you decide which CMS is right for your project, and then we'll help you develop out your site.
